Pet Valu likely target in tainted petfood suit

Canadian retailer Pet Valu Canada Inc. said that it may be included in a potential class action lawsuit arising from the Menu Foods Income Fund tainted petfood case.

Pet Valu said a motion has been filed to include it and unnamed other
retailers in Ontario litigation.

At last count Menu Foods faced 90
lawsuits over its recall in March of 60 million cans  and pouches of petfood. A number of cats
and dogs had died after eating “cuts-and-gravy” products containing tainted
wheat gluten from a supplier in China.

Pet Valu, which has about
340 stores in Ontario, Manitoba and the eastern United States, noted that it is
not named in various other lawsuits concerning the same allegedly poisonous
petfood.

An Ontario Superior Court hearing has been set for Sept. 27 in to
determine which lawsuits should proceed in the province.
