Degussa loses appeal against EU cartel fine

22-05-2008 | |

Evonik Degussa lost its appeal on Thursday against a European Court of First Instance ruling on a fine for taking part in an animal feed cartel.

The European Union’s second highest court said it had
dismissed Evonik Degussa’s appeal in its entirety and that the €91 million
($143.4 million) fine therefore stood. The company had been fined for fixing the price of a
chemical used in feed for poultry and pigs after a probe into the industry by
the bloc’s top antitrust body, the European Commission.

In 2006 the EU Court of First
Instance reduced a fine levied by the Commission from €118 million €91 million
but upheld the Commission’s charge that Evonik Degussa had been breaking EU law.
